Hi b789, I trust all is well? A family member (another one!), got the below parking fine, ironically it's at the same place for the second time, even though they enter their details in the VRM terminal to go the the local gym, it seems to be hit and miss. 

Last time I used the following appeal and won, I've noticed they've changed the layout of their 'PCN', can you please check and approve if my appeal is ok?

Dear Sirs,

I have received your Parking Charge Notice (Ref: XXXXXX) for vehicle registration mark XXX XXXX, in which you allege that the driver has incurred a parking charge. I note from your correspondence that you are not seeking to hold me liable as the registered keeper, under Schedule 4 of the Protection of Freedoms Act 2012 ("The Act"). You have chosen not to issue a Notice to Keeper in accordance with The Act, and it is now too late for you to do so.

There is no obligation for me to name the driver and I will not be doing so. I am therefore unable to help you further with this matter, and look forward to your confirmation that the charge has been cancelled. If you choose to decline this appeal, you must issue a POPLA code.

The suggested appeal is fine. I would only slightly tighten it like this:

I appeal as the registered keeper. No driver has been identified and no admission is made as to the identity of the driver.

I note from your correspondence that you are not seeking to hold me liable as the registered keeper under Schedule 4 of the Protection of Freedoms Act 2012. You have chosen not to issue a Notice to Keeper in accordance with Schedule 4 of that Act, and it is now too late for you to do so.

There is no obligation for me to name the driver and I will not be doing so.

As APCOA cannot transfer liability to me as registered keeper, and as the driver has not been identified, there is no basis on which APCOA can hold me liable for this charge.

Please confirm that the charge has been cancelled. If you reject this appeal, you must issue a POPLA verification code.

Keep in mind that APCOA are benign. I am not aware of anyone ever being taken to court by them. So, no matter the outcome of the appeal, or POPLA if it progresses that far, nothing will come of it.

Just to advise they cancelled this charge, not sure what all the extra fluff is for....

We have carefully reviewed your appeal and the evidence provided, taking into consideration all the points you have raised and, on this occasion, we have decided to cancel this Parking Charge.

At the time the ANPR cameras observed the vehicle they noted that it had used the car park without a valid payment, therefore it was parked in breach of the terms and conditions of the car park and a Parking Charge was issued.

It is the motorist’s responsibility to ensure that they read the terms and conditions on the signage in the car park and that they have a valid payment for the entire time that they use the car park. The signage within the car park informs the motorist that a Parking Charge will be issued if they fail to make a valid payment.

As this Parking Charge has been cancelled, there is no further action required by you at this time.

Chancers I suspect.

For every 100 of these they issue, even if 30 challenge (and most Brits just cough up to avoid hassle) that's still 70 x £xxx in their bank account.

It's a racket which is why forums such as this are invaluable; these shysters need to know their activities aren't always going to work.
