I cannot reconcile these references. How can you cause the company to incur a cost in this way when employee contracts apparently make it explicit that the employee is liable? I've just spent some time looking at the tax issues involved here and they're complex. In addition, if the full charge was to be paased to the driver because the employer (in the guise of you) chose to take the matter to appeal, then this would be for the full charge. But the driver could have paid the lower charge earlier. Why should their liability be determined other than by them?
I am not being critical of your role, it's unenviable to say the least. Yes, we could all agree that PPCs are scumbags, but this is not my point: in my opinion there are wider matters.
