Thank you for all the guidance, without which I probably wouldn't have taken it this far. Burgess of course did not attend but an agent did. The judge said he could not find VCS v Edward online but fortunately I had printed off copies of it. The judge was very helpful. The judge awarded me £103 costs.
For anyone else reading this in a similar situation, the judge agreed that I was under no legal obligation to disclose who the driver was to VCS. He said that there may be a gap in the law but it was not for this court to act on that.
Excellent news @benb76. If you can give a bit of a fuller description on how the day went, it would be of enormous benefit to others who may be worried about how these cases go.
Did you get a chance to mention the VCS v Langley case and that their advocate should not have a right of audience? That case would have been exactly the same circumstances.
Hi, yes, I did start with VCS v Langley but unfortunately the judge was not persuaded and allowed the agent a right of audience. However, generally the judge was very helpful and picked apart JB's witness statement and asked the agent lots of questions, found lots of holes in the evidence. I will come back on here tomorrow and provide some further details of the day as I would like to encourage others to have a go as I did. Thanks again.
