Received POC from BWLegal on behalf of UK CPM Ltd
#42
@Barbudaprince, thank you for providing the final court order and clarifying what District Judge Ross said at the earlier hearing. This is potentially very useful evidence for defending the current claim.

The judgment dated 27 August 2026 confirms that UKCPM was awarded £100 plus £199 costs, totalling £299. As the original claim concerned three separate £100 PCNs, the fact that judgment was awarded for only £100 strongly supports your account that UKCPM succeeded on just one PCN and that the other two were dismissed.

More importantly, you have confirmed that the Judge dismissed those two PCNs because the vehicles were parked outside UKCPM's enforcement boundary and were not parked on access roads or roadways, as defined by the signage.

You have also confirmed that the vehicle involved in this new claim was parked in exactly the same location as the vehicles involved in those two dismissed PCNs.

That is potentially significant because we may now have grounds to advance an argument based on issue estoppel.

Issue estoppel arises where an issue has already been conclusively determined between the same parties in earlier proceedings. Although this claim concerns a different vehicle and a separate PCN, UKCPM may be prevented from reopening an issue that was necessarily decided in the earlier case.

If District Judge Ross determined that the particular location was outside UKCPM's authorised enforcement boundary, and the contractual arrangements have not changed, there is a credible argument that UKCPM should not be permitted to relitigate that same issue.

However, there is a distinction we need to establish. The present PCN alleges "Not Displaying a Valid Permit", whereas your account of the earlier judgment also refers to the prohibition on parking on access roads or roadways. We need to distinguish between a finding that UKCPM lacked enforcement authority over that location altogether and a narrower finding that the access-road prohibition simply did not apply. The former would make an issue-estoppel argument considerably stronger.

There is also the separate question of unreasonable claim-splitting. UKCPM already knew about this March 2025 PCN when it commenced the earlier proceedings in July 2025, yet chose to issue a further claim against the same defendant at the same residential development. That may support an additional argument concerning oppressive litigation and abuse of process under the principles of Henderson v Henderson.

We already have the court's written judgment confirming that only £100 of the original £300 in parking charges was awarded, together with your first-hand account of the Judge's reasons for dismissing the other two PCNs. That is a substantial evidential basis for raising the earlier decision.

A transcript of the Judge's oral reasons would undoubtedly strengthen an issue-estoppel argument, because the written order does not expressly record the enforcement-boundary findings. However, transcripts must ordinarily be paid for, and the expense could be disproportionate to a claim of this value.

Importantly, even if the present claim were dismissed on the grounds of issue estoppel, you would not automatically recover the cost of obtaining a transcript. Small-claims costs are restricted by CPR 27.14. Although the court can award additional costs where a party has behaved unreasonably, merely losing a claim, even on an estoppel argument, does not automatically establish unreasonable conduct.

If UKCPM continued pursuing the claim despite being clearly informed of a binding earlier determination concerning the same enforcement boundary, that could strengthen an application for unreasonable-behaviour costs under CPR 27.14(2)(g). However, recovery would remain at the Judge's discretion, and I would not incur transcription expenses on the assumption that BW Legal would ultimately have to reimburse them.

My preference is therefore to rely initially on the existing court order, your account of the hearing and the evidence identifying the precise parking location. If the wording of the earlier oral judgment becomes decisive and UKCPM disputes your account, we can reconsider whether obtaining a transcript of the judgment reasons alone, rather than the entire hearing, would be proportionate.

For now, BW Legal remains subject to the unless order requiring amended Particulars of Claim by 4pm on 28 October 2026. I expect they will attempt to comply, but if they fail, the claim will be struck out automatically unless the court subsequently grants relief.

If amended Particulars are served, we will examine them alongside the earlier judgment, enforcement-boundary evidence, tenancy agreement, signage, incorrect postcode and PoFA defects before preparing the amended defence.

As you will be abroad, please arrange for someone to check your post. BW Legal is not necessarily obliged to serve the amended Particulars by email, and the court has allowed only 14 days from service for your amended defence.

For now, do not spend money on a transcript or make a separate application. We have enough to preserve the issue-estoppel argument, and the immediate priority is seeing whether BW Legal complies with the unless order.
