@JoeBloggs90, Nothing unusual has happened. The mediation has simply failed to produce a settlement (no surprise) , which means the claim now continues through the normal small claims process. HMCTS confirms that where mediation does not resolve the dispute, the case proceeds towards a hearing.
If the mediator calls back with an offer, you are free to reject it. You are not obliged to compromise simply because mediation has taken place.
The next step is normally for the court to issue further directions and, ultimately, a hearing date. Once allocated to the small claims track, the court will give directions about what each side must file and serve and by when. The standard direction is usually that the documents and evidence relied upon must be served on the other side and the court at least 14 days before the hearing, although the actual court order must always be followed because it can specify something different.
That is the stage when we would prepare the Witness Statement and evidence bundle properly, including the byelaws, signage, Bewl Water's contradictory published parking information, the landowner complaint and anything else relevant. There is nothing further you need to file immediately just because mediation has failed.
Also, do not read anything into the claimant apparently wanting more than £500 for two PCNs. That is simply the amount they are now pursuing in the proceedings. The merits of the underlying claims remain to be determined.
For now, wait for the next court order or notice and post it here when it arrives. As already mentioned, there is still a considerable period before any final hearing, and DCB Legal are 99.9% likely to discontinue before then.
