Thank you for your email.
We have considered the points raised within your Subject Access Request.
Under Article 15 of the UK GDPR, an individual is entitled to receive a copy of the personal data held about them. On this occasion, we have provided the personal data that we hold relating to you and your vehicle registration in connection with Parking Charge Notice HP5199561 and the processing of that Parking Charge from the date the charge was incurred.
We are only able to disclose personal data that relates to you as an identifiable individual. The scope of a Subject Access Request does not extend to information that is not your personal data, nor does it require the disclosure of information relating to other individuals, commercially sensitive information, internal business processes, or information that does not specifically identify you.
With regard to your request for details of investigations carried out following the cancellation of the Parking Charge, any technical reviews or investigations undertaken concerned the operation and performance of the ANPR camera system generally. These investigations relate to the cameras and associated systems as a whole and do not constitute personal data relating specifically to you or vehicle registration *****. As such, this information does not fall within the scope of your Subject Access Request.
We have therefore supplied the personal data held in relation to you and the Parking Charge in accordance with our obligations under the UK GDPR.

Thank you for your correspondence.



As previously advised, our investigation established that an ANPR capture relating to your vehicle was missed, resulting in the Parking Charge being issued incorrectly. Whilst errors are mercifully rare, there are a number of possible reasons why a vehicle registration may be either missed or unreadable by an ANPR camera. These can range from another vehicle driving too closely to the photographed vehicle during busy periods, through to a number plate that is obscured due to poor weather conditions or dirt.



We acknowledge the distinction you have drawn between a complete failure to capture vehicle movements and the alternative possibility that images were captured but not correctly associated with the vehicle registration. No additional ANPR events, partial reads, rejected reads or unmatched vehicle images associated with the vehicle registration were identified. However, we are unable to provide further detail regarding the operation of our ANPR systems, their configuration, or any internal technical investigations, as this information is commercially sensitive and forms part of our proprietary systems and processes.



We note your comments regarding the probability of missed captures and the operation of manual review processes. Whilst all Parking Charges generated through ANPR are subject to review prior to issue, that review can only be undertaken using the information available at the time. Unfortunately, as with any technology-based system, there are occasions where vehicle movements are not successfully recorded. Whilst such occurrences represent a very small proportion of the overall volume of vehicle movements processed by our systems, we do not disclose internal operational statistics, performance metrics or commercially sensitive business data.



We further note your comments concerning the Private Parking Sector Single Code of Practice and the issue commonly referred to as "double dipping". Horizon Parking remains committed to operating its ANPR systems in accordance with applicable British Parking Association requirements and undertaking appropriate reviews of parking events before Parking Charges are issued. In this instance, the information available at the time did not indicate that the recorded sequence was incomplete. When the additional evidence was subsequently provided, the matter was reassessed and the Parking Charge was cancelled accordingly.



With regard to the questions raised concerning cancellations, audits, compliance reviews and any investigations undertaken at this location, we are not obliged to disclose internal business records, compliance activity, audit information, commercial statistics or details of investigations carried out on behalf of our clients. We are therefore unable to provide the information requested in this regard.



In respect of your Subject Access Request, we can confirm that this has been responded to by our Data Protection Team on 6 September. 



Having carefully reviewed the matters raised, we are satisfied that the Parking Charge was appropriately cancelled once the additional evidence became available and that no further action is required in relation to the charge itself. We have also considered your concerns regarding ANPR reliability and our review processes and these comments have been recorded as part of our complaint investigation.



Accordingly, this letter constitutes Horizon Parking's final response to your complaint. Should you remain dissatisfied with our response, you may refer the matter to the British Parking Association or raise the matter with any other body you consider appropriate
