Have this private PCN from like april lol
#1
The PCN is attached below.

I was parked here to do a parcel delivery, my first time in this confusing car park, I literally walk around for 20-30 minutes total to find the customer and then also to find my vehicle, finding my vehicle took me like 20 minutes, until I realised it was on the eastern side car park, I was on the western side, with the actual shop in the middle, wasn't sure which way it was so I took the wrong car park. Their cameras will literally see me with a parcel in my hand and wandering around confused on where to go., unless since it's been 9 months this would've been recorded over by now.

As you can see from the PCN letter, I have not responded to them at all, no intentions to pay anything. Just wondering since it's 9 months into it, what can I do if anything to make them go away?

Cheers

Welcome to the forum @cringepcnskekw. You do seem to have collected a few Parking Charge Notices (PCNs).

Regarding this one, for now, ignore DCBL completely. They are powerless debt collectors and have no powers to enforce payment. Their threatening letters are designed to frighten and intimidate people into paying. The letter confirms that the matter has merely been referred back to Euro Car Parks (ECP) to consider legal action. No court proceedings have been issued.

What will almost certainly happen next is that ECP will eventually instruct DCB Legal (a sister company of bulk litigation solicitors), who will issue a formal Letter of Claim (LoC). If that is ignored, they will probably issue a County Court claim.

However, this is where their business model becomes important.

DCB Legal's modus operandi is well established. They issue hundreds of thousands of speculative parking claims, relying on the "low-hanging fruit on the gullible tree" — people who are sufficiently frightened or ignorant of the legal process that they pay up rather than defend themselves.

The claims themselves are effectively a loss leader. DCB Legal rely on enough frightened recipients paying to make the whole operation worthwhile. For those who understand the process and properly defend the claim, it is an entirely different story.

In every DCB Legal case we have dealt with where a proper defence has been submitted, the claim has ultimately been discontinued. Every single one.

Their usual procedure is to issue the claim, proceed through the initial court stages, attend the mandatory mediation (where they will be offered £0), and subsequently make increasingly desperate settlement offers. Those offers should be ignored or rejected.

When the case approaches the stage where DCB Legal must pay the £27 trial fee to proceed to a hearing, they routinely discontinue instead. That is their established modus operandi.

So, the prospect of receiving a County Court claim is not something that should frighten you into paying this speculative charge. It simply means that you must follow the correct procedure, meet the court deadlines and defend the claim properly.

There is one particularly important point in your case. You have already described the circumstances of the parking event, but there is absolutely no reason to volunteer that information to ECP or DCBL. Provided the driver has not already been identified to ECP, do not identify the driver now.

ECP can only transfer liability from an unidentified driver to the registered keeper if they have complied with the strict requirements of Schedule 4 of the Protection of Freedoms Act 2012 (PoFA). There is no automatic presumption that the registered keeper was the driver.

We therefore need to see the original Notice to Keeper (NtK), both sides, to establish whether ECP have complied with PoFA. If you no longer have it, submit a Subject Access Request (SAR) to ECP's Data Protection Officer (DPO) requesting all personal data held in connection with the PCN, including copies of all notices, photographs, ANPR records and correspondence. There is no requirement to identify the driver when making that request.

As for the parcel delivery and the time spent trying to find the customer and subsequently your vehicle, those circumstances may provide additional arguments, but there is no point developing them until we have examined the original NtK and evidence.

My advice is straightforward:

1. Ignore DCBL and their demands for £170.
2. Do not identify the driver to ECP, DCBL or DCB Legal.
3. Show us the original NtK, front and back, or obtain it through a SAR.
4. If a Letter of Claim (LoC) arrives from DCB Legal, come back here for assistance responding.
5. If a County Court claim is issued, do not ignore it. We will assist with the Acknowledgment of Service (AoS), defence and subsequent court procedure.
6. Do not engage with settlement offers. There is no reason to pay anything simply to make the claim go away.

The objective is not to persuade DCBL to stop sending letters. It is to ensure that, if DCB Legal follow their usual litigation strategy, you are one of the defendants who properly defends the claim and sees it discontinued rather than becoming another paying customer.

That is exactly how we deal with these claims.
