Re: dcbl letter of debt recovery says 'Unpaid CCJ'

@Rosa23, there is nothing particularly unusual about CNBC's response, although I appreciate how frustrating it must be. Because ParkingEye issued the claim electronically, CNBC does not hold a physical claim form. That does not mean there is no record of the proceedings. The claim details are held electronically, which is how CNBC was able to provide the claim issue date, service address, particulars of claim and judgment details over the telephone.

When you requested the details, did you ask for the Particulars of Claim (PoC)? You can ask them to email you all the details they have on file. They just won't have a physical copy of the claim form.

I would not bother paying for copies at this stage. We already have the essential information, including the actual claim number, N0FC8H6V, and there is no need to incur further expense while waiting for ParkingEye's response.

The TR1 obtained from the solicitors is useful evidence as it establishes when ownership of the former property was transferred. However, if possible, also obtain something confirming when you actually moved or notified others of the new address. This could be a council tax record, utility bill, bank statement or an email from a bank, insurer or service provider acknowledging the change of address before 6 July 2026. Such evidence would strengthen the witness statement supporting the set-aside application.

Regarding ParkingEye's failure to acknowledge the address correction, retain the email sent to its DPO and evidence of when it was sent. ParkingEye has been expressly notified of the current address and must ensure its records are accurate.

Monday 26 October remains the deadline for ParkingEye to respond to the formal request for consent, assuming that is the seventh working day following receipt. There is no need to chase ParkingEye before then. If no satisfactory response is received, we proceed with the contested N244 application without further unnecessary delay.

The application will be supported by a witness statement (WS) explaining that you moved in April 2026, ParkingEye issued proceedings to the former address on 6 July 2026, default judgment was entered on 4 August 2026, and you only discovered the proceedings in October upon receiving DCBL's letter. Our primary argument will be for a mandatory set-aside under CPR 13.2, based on defective service under CPR 6.9, with CPR 13.3 relied upon in the alternative if necessary.

The TR1, any additional address evidence, DCBL correspondence and the consent request to ParkingEye will form the supporting exhibits. Continue gathering the evidence and report back when ParkingEye responds or the deadline expires. We can then finalise the N244 application, witness statement and draft order.

Thank you.

Trying to locate Utility bills from that time, and a closing statement for Council tax.

Kind regards.
