RE: Claim form received from two alleged contraventions 3 years ago - SMART PARKING - b789 - 06-04-2026 You should now submit a short defence through MCOL. Whilst MCOL is limited in that it does not allow formatting or the attachment of transcripts and other documents, it has the important advantage of being submitted instantly and entered into the court system immediately. Given the continuing administrative failures at the CNBC, that is now the safer course. Any authorities, transcripts or other documents can be filed later with the Witness Statement if the claim progresses that far. So, you can log into MCOL and copy and paste the following as your defence: Quote:1. The Defendant denies the claim in its entirety. The Defendant denies any liability to the Claimant and denies that any debt is owed. RE: Claim form received from two alleged contraventions 3 years ago - SMART PARKING - JoeBloggs90 - 06-04-2026 Thank you for taking the time to craft a defence with some of my points in it and referencing various cases. The work you do here on this forum is greatly appreciated. I have submitted defence just now via MCOL. RE: Claim form received from two alleged contraventions 3 years ago - SMART PARKING - b789 - 06-04-2026 I can still assure you that the odds of this claim ever reaching a hearing in court are zero to none. I would love to see them try and argue their case in front of a judge. RE: Claim form received from two alleged contraventions 3 years ago - SMART PARKING - JoeBloggs90 - 07-17-2026 Just as an update I received a Notice of proposed Allocation to the small Claims track dated 9th Jul 2026 with an attached N180 questionaire. I would like to keep all replies digital and not rely on posting anything. RE: Claim form received from two alleged contraventions 3 years ago - SMART PARKING - b789 - 07-17-2026 Download your own N180 and follow this advice: Quote:You can check your MCOL history to see when your own N180 has been issued or just wait to receive it in the post. Having received your own N180 (make sure it is not simply a copy of the claimants N180) or been notified on MCOL that yours has been sent, do not use the paper form. Ignore all the other forms that came with it. you can discard those. DO NOT scan it. Download your own N180 DQ here and fill it in on your computer. You sign it by simply typing your full name in the signature box. RE: Claim form received from two alleged contraventions 3 years ago - SMART PARKING - JoeBloggs90 - 07-20-2026 Thank you - completed and emailed off. RE: Claim form received from two alleged contraventions 3 years ago - SMART PARKING - JoeBloggs90 - 09-02-2026 B789 - No updates yet with mediation scheduled for 29th Sept to which I will follow same advice as the other Bewl Water case offering zero. I am getting calls from what I suspect is DCB legal every few days, it is utterly relentless and I keep ignoring - safe to do so? Is there anyway to have them stop calling me? Should I answer and politely tell them to F.O ? RE: Claim form received from two alleged contraventions 3 years ago - SMART PARKING - b789 - 09-02-2026 Just block their number. It’s the usual final death throes of DCB Legal hoping you are low-hanging fruit on the gullible tree who will cave under pressure and settle for anything. RE: Claim form received from two alleged contraventions 3 years ago - SMART PARKING - JoeBloggs90 - 09-29-2026 B789 - as a follow up, I have just conducted an extremely brief meditation called and offered a grand sum of £0.00 for the two "contraventions" which mediator says they are claiming north of £500 for. I have mentioned I will not be open to any counter offers and not pay 1 single penny towards the claims which I defined as "bogus". I mention that I am willing to go to Court to defend the case. He will make that position clear, although mentioned he will call back as they will likely make an offer which he needs to pass on either way, to which I will reject. Following this call - I am unclear on what next steps would be. Thank you RE: Claim form received from two alleged contraventions 3 years ago - SMART PARKING - b789 - 09-29-2026 @JoeBloggs90, Nothing unusual has happened. The mediation has simply failed to produce a settlement (no surprise) , which means the claim now continues through the normal small claims process. HMCTS confirms that where mediation does not resolve the dispute, the case proceeds towards a hearing. If the mediator calls back with an offer, you are free to reject it. You are not obliged to compromise simply because mediation has taken place. The next step is normally for the court to issue further directions and, ultimately, a hearing date. Once allocated to the small claims track, the court will give directions about what each side must file and serve and by when. The standard direction is usually that the documents and evidence relied upon must be served on the other side and the court at least 14 days before the hearing, although the actual court order must always be followed because it can specify something different. That is the stage when we would prepare the Witness Statement and evidence bundle properly, including the byelaws, signage, Bewl Water's contradictory published parking information, the landowner complaint and anything else relevant. There is nothing further you need to file immediately just because mediation has failed. Also, do not read anything into the claimant apparently wanting more than £500 for two PCNs. That is simply the amount they are now pursuing in the proceedings. The merits of the underlying claims remain to be determined. For now, wait for the next court order or notice and post it here when it arrives. As already mentioned, there is still a considerable period before any final hearing, and DCB Legal are 99.9% likely to discontinue before then.
